§ 1 Scope and Subject Matter of the Contract
(1) These General Terms and Conditions (GTC) govern the use of the mobile application “Basentracker” (hereinafter referred to as the “App”) by the user.
(2) The subject matter of the contract is the provision of the App as software for tracking foods, calculating the PRAL value, managing recipes, AI-assisted recognition of foods and recipes from photos, and synchronizing data. The App is offered in a free basic version (“Free”) and a paid subscription version (“Premium”).
(3) These GTC apply to all users of the App within the territory of the European Union. Conflicting or deviating terms of the user are not recognized unless the provider expressly agrees to their validity in writing.
(4) Use of the App is permitted only for persons who have reached the age of 16.
(5) § 4a additionally applies to the purchase of digital content via the website basentracker.com.
§ 2 Conclusion of Contract and User Account
(1) The user agreement is concluded when the App is downloaded and a user account is successfully registered. For the purchase of Premium features, a separate contract is concluded via the respective app store platform (Apple App Store, Google Play Store).
(2) Registration requires a valid e-mail address, which the user must confirm with a code sent to them, or sign-in via a Google account (Android) or an Apple ID (iOS). The user is obligated to choose a secure password and to keep it confidential.
(3) Sharing a user account with third parties is prohibited.
(4) The provider is entitled to automatically and irrevocably delete user accounts after more than 24 months of inactivity, following prior notice by e-mail.
§ 3 Scope of Services
(1) Core features (Free version): The free version of the App includes basic features such as manually logging foods, calculating the PRAL value, and limited recipe management. The exact scope of features may change and is described in the App description in the respective app store.
(2) Premium version: The paid Premium version extends the range of features, e.g., with unlimited recipe storage or advanced statistics. The current Premium features are listed in the App and in the app store description.
(3) Data storage: The user's entries, recipes and settings are stored on the provider's server; the App does not create a permanent copy on the device. An active internet connection is therefore required to use the App. The user can request their entries as a file by e-mail at any time via the App's export function.
(4) AI-assisted photo recognition: The App allows the user to log foods and recipes by taking photos. For this purpose, the captured images are transmitted via the provider's server to an external AI service provider (Google Gemini) and analyzed automatically; the provider does not store the images. The results of the AI recognition (e.g., recognized foods, quantities or PRAL values) are generated automatically and may be incorrect or inaccurate. They are merely a non-binding suggestion and do not replace the user's own review. The provider assumes no warranty for the accuracy or completeness of the results generated by the AI. The user is obligated not to upload any photos to which they do not hold the rights or which contain personal data of third parties.
(5) Availability: The provider strives for the highest possible availability of the App and the server services. However, uninterrupted availability is not guaranteed (provided “as is” and on a “best effort” basis). Maintenance work, technical malfunctions or other events may lead to temporary restrictions.
(6) Database: The App accesses an extensive food database. The rights to this database are held by the provider.
§ 4 Prices, Payment and Cancellation (Premium Subscriptions)
(1) Use of the Premium version is subject to a fee. The current prices for weekly, monthly and annual subscriptions are displayed in the App and in the respective app store.
(2) Payment is processed exclusively via the respective platform provider (Apple App Store or Google Play Store). Their payment terms apply.
(3) Subscriptions renew automatically for the originally selected term (e.g., one week, one month or one year) unless they are canceled before the end of the current term.
(4) The user must cancel a subscription directly in the subscription settings of their app store account (Apple ID or Google account). Cancellation within the App or by e-mail to the provider is not technically possible.
(5) After cancellation, the subscription continues until the end of the paid period. Pro-rata refunds for periods already paid are excluded. After the subscription expires, the user account is automatically downgraded to the Free version.
(6) The right of both parties to terminate for good cause remains unaffected. Good cause for the provider exists in particular in the event of a serious breach of these GTC by the user.
§ 4a Purchase of Digital Content via the Website (Alkaline Food List as a PDF)
(1) Subject matter: Via the website basentracker.com, the customer can purchase digital content, currently the “alkaline food list as a PDF” (a PDF file; content and scope as described on the product page). No user account is required for the purchase.
(2) Conclusion of contract: The presentation of the product on the website does not constitute a binding offer. By clicking the “Pay” button in the checkout of our payment service provider Stripe, the customer submits a binding offer. The contract is concluded as soon as the payment has been successful; we confirm this by redirecting the customer to the download page and by e-mail.
(3) Prices and payment: All prices are final prices including statutory VAT. Payment is processed by Stripe Payments Europe, Ltd. (Dublin, Ireland). The payment methods shown in the checkout are available (e.g., credit or debit card, Apple Pay, Link, PayPal, Klarna). For payment with PayPal or Klarna, their terms apply in addition.
(4) Delivery: Immediately after successful payment, we make the file available for download and send a download link to the e-mail address provided during checkout. A download link is valid for seven days and can be used up to five times. The customer can request a new link at any time at basentracker.com/resend-pdf/.
(5) Rights of use: The customer receives a non-exclusive, non-transferable, perpetual right to use the file for private, non-commercial purposes, in particular to save it and to print it for personal use. Passing it on to third parties, publishing it, making it publicly available, and any commercial use are not permitted. Each file is marked in the footer with the customer's e-mail address; this marking may not be removed or altered.
(6) Content: The values are based on the provider's food database (PRAL after Remer & Manz). They are for general information only and do not replace medical or nutritional therapy advice.
§ 5 Right of Withdrawal for Consumers
Consumers are generally entitled to a statutory right of withdrawal.
Withdrawal Instructions
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (Nicolas Goldstrass, Wackersbergerstr. 33, 81371 München, info@basentracker.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by mail or an e-mail). You may use the model withdrawal form below, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notice of exercising the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this contract, we must refund all payments we have received from you without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract.
Special note: Early expiry of the right of withdrawal
For contracts for the supply of digital content not supplied on a tangible medium (such as unlocking Premium features), your right of withdrawal expires if you have expressly consented to us beginning performance of the contract before the end of the withdrawal period and you have acknowledged that, by giving your consent, you lose your right of withdrawal once performance of the contract begins. This consent and acknowledgment are usually requested by the app store before the purchase.
When purchasing digital content via the website (§ 4a), we request this consent and acknowledgment via a checkbox in the checkout before the purchase is completed. The customer receives confirmation of the contract, including this declaration, by e-mail.

§ 6 Rights of Use and User-Generated Content
(1) The provider grants the user a non-exclusive, non-transferable right to use the App for their own non-commercial purposes in accordance with these GTC.
(2) All rights to the App itself, the underlying software and the food database remain with the provider.
(3) Content that the user creates themselves (e.g., their own recipes, “user-generated content”) remains the property of the user. However, the user grants the provider the non-exclusive, worldwide and royalty-free right to store, reproduce and technically process this content to the extent necessary to provide the App services (in particular synchronization and display).
§ 7 Prohibited Uses
The user is prohibited from:
a) decompiling or reverse engineering the App or its underlying systems, or otherwise attempting to gain access to the source code.
b) using automated systems (e.g., bots, crawlers) to access the App or its servers.
c) using the App commercially without an express written license.
d) manipulating or interfering with the interfaces between the App and the provider's server.
§ 8 Limitation of Liability
(1) The App does not constitute medical advice. The information displayed in the App, in particular nutritional information and PRAL values, is provided solely for information and guidance. It does not replace professional nutritional counseling or a medical diagnosis. Decisions regarding your own health should always be made together with a qualified doctor or nutritionist.
(2) The provider assumes no warranty for the accuracy, completeness or timeliness of the nutritional information in the food database.
(3) Otherwise, the provider is liable without limitation only for intent and gross negligence. In the event of a slightly negligent breach of essential contractual obligations (so-called cardinal obligations), the fulfillment of which makes the proper performance of the contract possible in the first place, liability is limited to the foreseeable damage typical for this type of contract.
§ 9 Data Protection
Personal data is processed exclusively within the framework of the statutory provisions, in particular the General Data Protection Regulation (GDPR). Detailed information can be found in our separate Privacy Policy, which is available at any time in the App and on our website.
§ 10 Changes to the GTC
The provider reserves the right to change these GTC. The user will be informed of changes by e-mail or by a notice in the App. The changes are deemed approved if the user does not object within 30 days of receiving the notice. The provider will specifically point out this consequence in the notice of change.
§ 11 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) The place of jurisdiction for all disputes arising from this contractual relationship is Munich, provided the user is a merchant.
(3) Should individual provisions of these GTC be or become invalid, this does not affect the validity of the remaining provisions (severability clause).
(4) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. You can find our e-mail address above. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
