When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Data Processing on Our Website

The following sections describe what data we collect and process when you use our website.

3. Hosting

We host the content of our website with the following provider:

Hetzner

The provider is Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany (hereinafter Hetzner); the website is served from the Nuremberg data center. For details, please see Hetzner’s privacy policy: https://www.hetzner.com/legal/privacy-policy/.

Hetzner is used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in presenting our website as reliably as possible. If corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law that ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

4. Data Collection on Our Website

Cookies

Our website uses so-called “cookies.” Cookies are small data packets and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies).

Cookies have various functions. Many cookies are technically necessary because certain website functions would not work without them. Other cookies may be used to analyze user behavior or for advertising purposes.

Necessary cookies are stored on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

Consent with Cookiebot

Our website uses Cookiebot’s consent technology to obtain your consent to the storage of certain cookies on your device or to the use of certain technologies and to document this consent in compliance with data protection law. The provider of this technology is Usercentrics A/S, Havnegade 39, 1058 Copenhagen, Denmark.

Cookiebot is used to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6(1)(c) GDPR.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources. This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website. For this purpose, the server log files must be collected.

Contact form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not share this data without your consent. This data is processed on the basis of Art. 6(1)(b) GDPR if your inquiry is related to the performance of a contract or is necessary to carry out pre-contractual measures. In all other cases, processing is based on our legitimate interest (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR). The data you enter in the contact form will remain with us until you ask us to delete it, revoke your consent to storage, or the purpose for storing the data no longer applies.

Technical transmission of the contact form

The contact form is operated without third-party providers. Your details (type of inquiry, name, email address, message) are transmitted in encrypted form to our own server (shop.basentracker.com) and forwarded from there as an email to info@basentracker.de. The content of your inquiry is not stored on the server itself; the server logs only record the technical access (including the IP address) for a maximum of 90 days. Your IP address is not included in the email. To protect against automated entries, we use an invisible form field and a limit on requests per hour; no captcha service is used.

Inquiries by email, phone or fax

If you contact us by email, phone or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of handling your request. This data is processed on the basis of Art. 6(1)(b) GDPR or our legitimate interest (Art. 6(1)(f) GDPR). The data you send us via contact requests will remain with us until the purpose for storing the data no longer applies.

Purchase of the alkaline food list as a PDF

Payment processing by Stripe: If you buy the alkaline food list as a PDF, you will be redirected to Stripe for payment. The provider is Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland. Stripe processes your email address, your name, your country, your payment data and technical data such as your IP address in order to process the payment, prevent fraud and comply with legal obligations. Stripe is itself the controller for part of this processing. A transfer to Stripe, Inc. in the USA is possible; it is based on certification under the “EU-US Data Privacy Framework” and the standard contractual clauses of the EU Commission. Details: https://stripe.com/de/privacy. If you pay with PayPal or Klarna, Stripe passes the necessary data on to PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg, or to Klarna Bank AB (publ), Stockholm; their privacy notices apply.

Delivery via our shop server: After payment, Stripe sends us your email address, the amount, the payment transaction ID and the time. We store this data on our own server at Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen (data center in Germany, data processing agreement), separately from the App data. We use it to display the download link and send it to you by email, to send you a new link on request (“Lost your PDF?”), and to insert your email address into the footer of the PDF as the label “For personal use only by …”. We send the emails via the mail server of ALL-INKL.COM - Neue Medien Münnich (data processing agreement).

“Lost your PDF?”: We match the email address entered there against our purchases. If there is a purchase, we send a new download link; otherwise, we do not process the address any further. To protect against misuse, we count requests per email address and IP address in memory for a maximum of one hour. Our web server logs access to the shop, including the IP address; we delete these logs after 90 days at the latest.

Legal basis and storage period: Processing is carried out to perform the purchase contract (Art. 6(1)(b) GDPR); misuse protection and server logs are based on our legitimate interest in secure operation (Art. 6(1)(f) GDPR). We delete download links 30 days after they expire, and the purchase data on our shop server three years after the purchase. Payment records that must be retained under tax and commercial law are held by Stripe and retained there for the statutory period (up to ten years).

This website uses Meta’s visitor action pixel for conversion measurement. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Meta, however, the collected data is also transferred to the USA and other third countries.

Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we need your email address and information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. No further data is collected, or only on a voluntary basis. To handle the newsletter, we use newsletter service providers, which are described below.

Rapidmail

This website uses Rapidmail to send newsletters. The provider is rapidmail GmbH, Augustinerplatz 2, 79098 Freiburg i.Br., Germany.

Rapidmail is a service that can be used, among other things, to organize and analyze the sending of newsletters. The data you enter for the purpose of receiving the newsletter is stored on Rapidmail’s servers in Germany.

Data analysis by Rapidmail

For analysis purposes, the emails sent with Rapidmail contain a so-called “tracking pixel,” which connects to Rapidmail’s servers when the email is opened. In this way, it can be determined whether a newsletter message has been opened.

Furthermore, with the help of Rapidmail, we can determine whether and which links in the newsletter message are clicked. All links in the email are so-called tracking links, which can be used to count your clicks. If you do not want Rapidmail to analyze your activity, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message.

For more details on Rapidmail’s analysis functions, please see the following link: https://de.rapidmail.wiki/kategorien/statistiken/.

Legal basis

Data processing is based on your consent (Art. 6(1)(a) GDPR). You can revoke this consent at any time. The lawfulness of data processing operations already carried out remains unaffected by the revocation.

Storage period

The data you provide to us for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe. Data stored by us for other purposes remains unaffected by this.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist if this is necessary to prevent future mailings. The data from the blacklist is used only for this purpose and is not merged with other data. This serves both your interest and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.

For more details, please see Rapidmail’s data security information at: https://www.rapidmail.de/datensicherheit.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law that ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Newsletters to existing customers

If you order goods or services from us and provide your email address in the process, we may subsequently use this email address to send newsletters, provided that we inform you of this in advance. In such a case, the newsletter will only be used to send direct advertising for our own similar goods or services. You can cancel receipt of this newsletter at any time. For this purpose, every newsletter contains a corresponding link. The legal basis for sending the newsletter in this case is Art. 6(1)(f) GDPR in conjunction with § 7(3) UWG.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us in a blacklist to prevent future mailings to you.

Data Processing in Our Mobile App “Basentracker”

The following sections describe what data we collect and process when you install and use our mobile App “Basentracker.” They apply from App version 1.5.0 onward. Since this version, we have operated the App’s servers ourselves; section 8 b) describes the transition phase for user accounts created with an earlier version.

7. Data Collection and Processing in the App

a) Downloading the App

When you download the App, the required information is transferred to the respective app store (Apple App Store or Google Play Store). We have no influence on this.

b) Creating a user account

A user account is required to use the App. When you register with an email address, we collect:

  • Email address (confirmed by a code sent by email)
  • Password (stored exclusively as an Argon2 hash and not visible to us)
  • A unique user ID (generated automatically)
  • Time of registration and of the last login

Alternatively, you can sign in with your Google account on Android devices and with your Apple ID on iPhones. In this case, after your confirmation, the respective provider sends us your email address and a provider-side user identifier; our server verifies the authenticity of this sign-in. No password is stored with us in this case. The providers are Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, and Apple Distribution International Ltd., Hollyhill Industrial Estate, Cork, Ireland. For information on what data these providers themselves process during sign-in, please see their privacy policies: policies.google.com/privacy and apple.com/legal/privacy.

This data is strictly necessary to provide your account, for authentication (login) and to store your entries.

Legal basis: This data is processed to perform our user agreement with you in accordance with Art. 6(1)(b) GDPR.

c) Processing of nutrition and health data

The core function of the App is recording and analyzing foods, their PRAL values and other nutritional information such as calories (kcal). The data you enter and store in the App (e.g., foods eaten, calorie values, recipes you create, favorites, your own nutritional values) may allow conclusions to be drawn about your health and eating habits. Under the GDPR, such data is considered a special category of personal data (health data).

This sensitive data is processed exclusively on the basis of your express consent in accordance with Art. 9(2)(a) GDPR. You give us this consent when you register or first sign in by confirming the terms of use and this privacy policy. Without this consent, the core functions of the App cannot be used.

You can revoke your consent at any time by deleting your user account in the App settings. Upon deletion, all of your nutrition and health data will be removed from our servers.

d) Subscriptions and in-app purchases (RevenueCat)

To manage premium subscriptions, we use the service RevenueCat, Inc., 620072, San Francisco, CA 94162, USA. When you take out a subscription, pseudonymized data such as your user ID, subscription status and transaction receipts from the app stores are transmitted to RevenueCat. RevenueCat reports changes to your subscription (purchase, renewal, cancellation, expiration) to our server; there we store the subscription status and expiration date with your user ID in order to unlock the premium features for you.

We ourselves do not store or process any sensitive payment data such as credit card numbers. Payment is processed exclusively via your account with the respective app store (Apple or Google).

The use of RevenueCat is necessary to handle the subscription contract. Insofar as data is transferred to the USA in the process, the transfer is based on the standard contractual clauses of the EU Commission.

Legal basis: Processing is carried out to perform the subscription contract in accordance with Art. 6(1)(b) GDPR.

For more information, please see RevenueCat’s privacy policy: https://www.revenuecat.com/privacy

e) Technical data and server logs

Whenever the App communicates with our server, technical data is processed: your IP address, the time and type of request, the response status and the App version. This data is stored in server logs to ensure the security and stability of the service and to fix errors. It is not merged with your nutrition data and is deleted after 90 days at the latest.

The App does not contain any analytics, tracking or advertising software and does not send push notifications.

Legal basis: Processing is necessary to perform the contract (provision of the App) in accordance with Art. 6(1)(b) GDPR and to protect our legitimate interests (security and technical functionality) in accordance with Art. 6(1)(f) GDPR.

f) App emails

We only send you emails when a function of the App requires it: the confirmation code during registration, the code for resetting your password and the data export you have requested (see g). The emails are sent via the mail server of our hosting provider ALL-INKL.COM - Neue Medien Münnich, owner René Münnich, Hauptstraße 68, 02742 Friedersdorf, with whom we have a data processing agreement. We do not send promotional emails from the App.

Legal basis: Art. 6(1)(b) GDPR (performance of contract).

g) Data export by email

At your request, we will send your entries for a selected period as a spreadsheet (CSV) and as a report (PDF) to the email address of your user account. These files contain your nutrition and health data. Please note that emails are not encrypted along the entire transmission path and that the files remain in your mailbox once they have been delivered. For each export, we only store the time and the selected period in order to limit the number of exports per day; the files themselves are not retained after they are sent.

Legal basis: Art. 6(1)(b) GDPR (performance of contract) and your express consent in accordance with Art. 9(2)(a) GDPR, which you give by triggering the export.

h) AI-based photo recognition (Google Gemini)

The App allows you to log meals, foods or recipes using a photo. If you actively use this function, the image you take is transmitted to our server and from there to the AI service “Gemini” of Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) for automatic recognition of the foods it contains, and is processed there. The result (e.g., recognized foods with quantities or a generated recipe) is returned to the App. Our server does not store the image; it is discarded after recognition. We only store the number of your recognitions per month in order to check the quota of your plan.

The transmission takes place only when you trigger the photo capture yourself. Only the respective image data is processed for the purpose of food recognition. As part of this processing, data may be transferred to third countries (including the USA). Google is certified under the EU-US Data Privacy Framework; in addition, the standard contractual clauses of the EU Commission apply.

Legal basis: Processing is based on your consent in accordance with Art. 6(1)(a) GDPR, which you give by actively triggering the photo capture, and on the performance of the contract in accordance with Art. 6(1)(b) GDPR. Please note that you should not upload photos that contain personal data of third parties (e.g., people shown in the photo).

8. Storage Locations, Storage Period and Data Security in the App

a) Storage on your device

The App does not create a copy of your entries on the device; your data is loaded from our server each time you use the App, which is why an internet connection is required. Only your login session (in the operating system’s encrypted storage, iOS Keychain or Android Keystore) and App settings such as the language are stored on the device.

b) Server and database

Your account and nutrition data is stored on a server operated by us. The server is operated at Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany, in the Nuremberg data center. We have a data processing agreement with Hetzner in accordance with Art. 28 GDPR. No data is transferred to third countries for storage.

Transition phase: User accounts created with an App version prior to 1.5.0 are additionally held by our previous service provider Supabase, Inc. (servers in Frankfurt am Main, Germany) until the first sign-in with the new version. To ensure the switch works without data loss, these accounts are continuously transferred to our own server. When you first sign in with the new version, your account is transferred permanently; once the migration is complete, the entire data set at Supabase will be deleted.

c) Security measures

We protect your data with modern technical and organizational measures. These include:

  • Transport encryption: All communication between the App and our server is TLS-encrypted.
  • Password security: Passwords are stored exclusively as hashes using the Argon2 method.
  • Access controls: Every request to our server is bound to your personal login session and limited to the data in your own account. The database can only be reached from the server itself; administrative access is restricted to the provider.

d) Storage period and deletion

We store your personal data only for as long as is necessary to achieve the respective purposes or as required by statutory retention periods.

  • Account data: Your profile data and the nutrition and health data stored in the App remain stored as long as your user account exists.
  • Account deletion: If you delete your account via the App settings, your personal data will be removed from our active systems immediately.
  • Backups: For data security reasons, backup copies of our database are created daily. After deletion from the active systems, your data may remain in these access-protected backup copies for up to 30 days before being permanently deleted.
  • Technical log data: Server logs are deleted after 90 days at the latest.

If we are legally required to retain data for longer (e.g., for tax or commercial law reasons), the data will be deleted after these periods expire.

9. Protection of Children and Minors

Our services are generally aimed at adults. Persons under the age of 16 are not permitted to use the App. We do not knowingly collect personal data from children and adolescents under the age of 16. If we discover that such data has been transmitted to us without the consent of the parents or legal guardians, we will delete it immediately.

10. Changes to This Privacy Policy

We reserve the right to amend this privacy policy so that it always complies with current legal requirements or to implement changes to our services in the privacy policy. In the event of significant changes, we will inform you in the App or by email. The new privacy policy will then apply to your next visit.
